   0:05from president obama
   0:07one speech that could have been billed as a ballad of the constitution a
   0:11proclamation of american values
   0:13a repudiation of the lawless behavior of the last presidential administration
   0:18and stan evans speech
   0:19announcing a radical new claim a presidential power that is not afforded
   0:23by the constitution and that has never been attempted in american history
   0:27even by george w_ bush and dick cheney
   0:30remarkably president obama today made both of those speeches
   0:34simultaneously
   0:35standing inside the national archives in front of the actual original
   0:39constitution
   0:40president obama delivered a blistering critique
   0:43of the bush administration in which he called their actions and their legacy
   0:46literally
   0:47a mess
   0:50more government maybe series of these decisions firmly planted a haphazard
   0:53approach
   0:55too often we set those principles aside as luxuries that we could no longer
   0:59afford our government made decisions based on fear
   1:03rather than foresight the decisions that were made over the last eight years
   1:06establishing an ad hoc legal approach for fighting terrorism
   1:10there was neither effective more sustainable

   1:23he announced his own
   1:25his own ad-hoc legal approach for fighting terrorism
   1:28president obama today proposed something new
   1:31something called prolonged detention
   1:34doesn’t sound that bad right prolonged detention

   1:40it was based on actual k dick short story came and he doesn’t it start tom

   1:45he played a police officer and something called the department of pre crime
   1:49pre crime is where people arrested and course rated to prevent crimes that they
   1:53have not

   2:11he didn’t do anything that you’re gonna

   2:15putting somebody in jail not for what they’ve done but

   2:22there may be any number of people who cannot be prosecuted for pastimes
   2:27in some cases because evidence may be tainted
   2:31but who nonetheless poses a threat
   2:34to the security of the united states
   2:37or not prosecuting them for
   2:39past crimes
   2:40but we need to keep them in prison because of our expectation
   2:45future crimes

   2:54must be prevented from attacking us again

   3:07that’s what president obama proposed today you strip away
   3:10the euphemisms
   3:11one civil liberties advocate told the new york times today quotes we’ve known
   3:15that this was on the horizon
   3:16for many years but we were able to hold off with george bush
   3:20the idea that we might find ourselves fighting with the old bal administration
   3:23over these powers
   3:25he’s really stunning
   3:27stunning particularly to hear president obama claim the power to keep people in
   3:32prison indefinitely with no charges against that no conviction of sentence
   3:36just imprisonment
   3:38it’s particularly stunning to hear him make that claim in the middle of the
   3:41speech
   3:42that was the hall about the rule of law
   3:45but we must do so with an abiding confidence in the wall our government
   3:51was defending positions and undermined the rule of law
   3:54to ensure that the airline wall
   3:57how can a president
   3:59speak the kind of poetry that president obama does about the rule of law
   4:03and call for the power to
   4:05indefinitely preventive leaving prison people because they might commit crimes
   4:09in the future
   4:11access to things co-exist in the same mayhem even in the same speech
   4:15well that brings us to be self-consciously awkward embarrassing
   4:18park of this speech today
   4:20after condemning the bush administration for what he called their ad-hoc legal
   4:24strategy
   4:24for trying to make things seem legal that patently works
   4:28this is what president obama perplexed
   4:32among the situation has begun to reshape
   4:35the standards that apply
   4:36to ensure that they are in line with the rule of law
   4:41we must have clear sensible
   4:44and lawful standards for those who fall into this category
   4:48we must have a process periodic review
   4:52exhibit any prolonged attention is carefully evaluated
   4:56her goal is to construct a legitimate and legal framework

   5:50so you can construct a whole new system outside the courts
   5:53even outside the military commissions
   5:55so that you can indefinitely imprison people without charges
   5:58and she’ll built that system from scratch
   6:01let’s add somebody said about ad-hoc legal strategies
   6:05just a context here in the united kingdom where there isn’t even a bill of
   6:08rights there’s been a major debate about whether people can be held in preventive
   6:12detention
   6:12former british prime minister tony blair wanted three months
   6:15to be the outer limit for how long anyone could be helds it was a big
   6:19political fight about it parliament ended up limiting that power to twenty
   6:22eight days twenty days is still the longest
   6:25period of preventive detention that’s allowed under law
   6:28in any comparable democracy anywhere in the world
   6:31along with president obama’s proposed preventive indefinite detention last
   6:36up he’s not saying yet but here’s how he defines the threat
   6:40but he says makes indefinite detention necessary
   6:44right now and doesn’t really do have some friends that these are people
   6:47plotting
   6:48to take american lives
   6:51no being the case in a year from now
   6:54five years from now
   6:56in all probability ten years
   6:59ten years from now
   7:00so you can get arrested today
   7:03and locked up
   7:04a trial without being convicted without being sentenced
   7:08for say
   7:09ten years
   7:10until the threat of your future criminal behavior passes
   7:14prolonged detention he’s calling it
   7:16this is a beautiful speech from president obama today with patriotic
   7:19moving even poetic language about the rule of law and the constitution
   7:24one of the most radical proposals for defying the constitution that we have
   7:27

   This is great! Now we can lock up some bankers and some war mongers. Maybe some senators and appointed officials too.
